Federal Judge Mandates Release of Abrego Garcia from Immigration Detention

A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.

The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer human smuggling allegations, he was held in immigration detention.

In her decision, the judge pointed out that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
